A Kitsap County Jail inmate accused of beating his 19-year-old cellmate after learning the other man faced a rape charge has been charged with a hate crime and assault.
Ivan Wade Case, 33, faces one count of a hate crime and one count of third-degree assault in the October 10 incident at the jail in Port Orchard. Prosecutors filed the charges October 16 in Kitsap County Superior Court.
Case denied hitting his cellmate. He told officers the man panicked after being ordered out of the cell, fell while climbing down from an upper bunk and struck his face on a desk. Sergeant Amber Nolan, who interviewed Case, reported seeing no marks on his hands.
The cellmate, William Alexander Bonilla, faces separate charges of third-degree rape and second-degree assault, both designated as domestic violence. He pleaded not guilty October 12.
Jail surveillance showed Bonilla being placed in Case's cell about 9:12 a.m. October 10, according to Nolan's report. Less than 20 minutes later, staff received an emergency call from the cell.
Corrections Officer Justin Nohrenberg found Bonilla at the door with blood on his face and the cell window, the officer wrote. Case was sitting on the lower bunk. Bonilla made a punching motion as he tried to explain what had happened, and Nohrenberg removed him from the cell and called for medical help.
Speaking in Spanish with Officer Juan Guerrero, Bonilla said he had been lying on his bunk while Case spoke with his wife on a video call. Case asked his name, and Bonilla showed him his identification wristband. Bonilla said Case began punching him in the head and face shortly after the call ended, Guerrero wrote.
Nolan and Sergeant Craig Ferguson reviewed Case's recorded video calls. In a call that began at 9:22 a.m., Case asked his wife to look up Bonilla's charges. His tone became aggravated after she told him the charges were third-degree rape and second-degree assault, Nolan reported.
Case repeatedly ordered Bonilla down from the upper bunk and threatened to kill him if he did not leave, according to Nolan. She described hearing loud banging and Bonilla screaming before the call disconnected.
In the next call, Case referred to himself as a “white boy,” called Bonilla a “fucking Mexican” and said “he's lucky I didn't bash his head in,” Nolan wrote.
Officers documented blood on the cell's floor, door and walls. A nurse reported a cut inside Bonilla's mouth, facial swelling and what appeared to be developing bruises, according to Nolan. Medical staff cleared him to remain at the jail. The men were moved to separate housing units.
Judge Tina Robinson set Case's bail at $10,000 on October 19 and prohibited him from contacting Bonilla. His next hearing is scheduled for November 18 at 9 a.m.
In Bonilla's separate case, Judge Jennifer Forbes set bail at $100,000. A surety bond filed October 13 lists his release date as October 12. His trial is scheduled for December 7, with an omnibus hearing November 10.
Both men are presumed innocent unless proven guilty.
